A Charter Ordinance exempting the City of Ottawa, Kansas, from the provisions of K.S.A. 3-113, and providing substitute and additional provisions on the same subject, relating to the issuance of general obligation bonds for the purpose of making certain improvements to the Ottawa Municipal Airport and facilities related thereto.

BE IT ORDAINED BY THE GOV ERNING BODY OF THE CITY OF OTTAWA, KANSAS:

SECTIQN l       The City of Ottawa, Kansas (the “City”), by the power vested in it by Article 12 Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 3-113, which provisions apply to this City but not uniformly to all cities, and to provide substitute and additional provisions as hereinafter set forth in this Ordinance .

SECTION 2      The City is hereby authorized and empowered to issue its general obligation bonds without an election in such amounts as may be determined by the governing body for the purpose of making improvements to the Ottawa Municipal Airport and facilities related thereto. Such improvements may include acquiring additional land, repairing, remodeling, constructing, reconstructing, purchasing, leasing and equipping runways, taxiways, aprons, hangars and any related facilities incidental and convenient to the operation of the City’s municipal airport.

SECTION 3      Whenever it is determined that the general obligation bonds should be issued, notice of such determination shall be given to the general public by publication once in the official city newspaper of the amount and purpose of the issue along with such information the governing body determines to be useful to the general public.

SECTION 4      Such general obligation bonds shall be issued, registered, sold, delivered and retired in compliance with the provisions of the general bond law.
