A.    It shall be unlawful to operate the following on the City sidewalks, as defined in this ordinance:

1.    Bicycles;

2.    Skateboards;

3.    Roller skates or similar devises;

4.    Unlicensed motorized vehicles;

5.    Vehicles similar to a bicycle, skateboard, roller skates, or unlicensed motorized vehicles.

B.    The above prohibition does not apply to the following:

1.    Children under 13 years of age when supervised by a parent or guardian so long as the child is operating a bicycle, skateboard or roller skates, or similar device.

2.    Law enforcement officers on official business may operate any vehicle they deem appropriate.

C.    For the purposes of the above prohibition, the downtown business district is defined as follows.

1.    The west side of Cedar St. to the east side of Walnut St., the south side of 5th St. to the north side of the Marais Des Cygnes River.

D.    Violation of this section is a misdemeanor, punishable by a fine not to exceed $100.00.

It shall be unlawful for any person to drive or operate an unauthorized motor vehicle upon the levee system of the flood protection project within the City.

It shall be unlawful for any person to operate any railroad train, engine or car upon, along or across any street, alley or ground within the corporate limits of the City at a speed greater than twenty (20) miles per hour.

A.    Trucks (except pick-up trucks, 1-ton payload and under) longer than twenty feet (20’) or heavier than twelve thousand (12,000) pounds (6 tons) are prohibited from traveling on streets and alleys within the corporate limits of the City of Ottawa not designated herein as Truck Routes.  Designated Truck Routes are:

This shall not apply to any truck when on the most accessible route to/from a pick-up or delivery, or to provide a service at a specific location.  No truck shall remain in a location not designated as a truck route for pick-up, delivery or service access for a period longer than two (2) hours.

Truck parking shall not be permitted in the Central Business District (CBD).  This prohibition includes trailers/semi-trailers, garage service cars, tractors, farm implement/machinery, and vehicles for sale (new or used). This parking prohibition shall not apply to vehicles actively engaged in loading/unloading.  Exceptions to this section may be granted by the Chief of Police or designate when justified (e.g. moving vans loading/unloading, etc.).

(a)   The driver of any vehicle shall obey the instructions of any official traffic-control device applicable thereto placed in accordance with the provisions of this ordinance, unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in this ordinance.

(b)   No provision of this ordinance for which official traffic-control devices are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official device is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that official traffic-control devices are required, such section shall be effective even though no devices are erected or in place.

(c)   Whenever official traffic-control devices are placed in position approximately conforming to the requirements of this ordinance, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence.

(d)   Any official traffic-control device placed pursuant to the provisions of this ordinance and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this ordinance, unless the contrary shall be established by competent evidence.

Where private driveways access private (business) parking lots from public rights-of-way, appropriate STOP signs shall be erected and maintained by private property owners.

There shall be no “U Turns” permitted on Main Street between Tecumseh and 5th Streets.  Further, crossing a double yellow line to enter a parking space on the opposite side of Main Street between Tecumseh and 5th Streets is prohibited.

A violation of any section of this article shall be a Class C misdemeanor unless otherwise specifically stated by the section.  Upon a second conviction within one (1) year thereafter, such person in violation shall be guilty of a Class B misdemeanor, and upon a third or subsequent conviction within one (1) year of the first conviction, such person shall be guilty of a Class A misdemeanor.
