A CHARTER ORDINANCE EXEMPTING THE CITY OF OTTAWA, KANSAS, FROM KANSAS STATUTES ANNOTATED 12-1005(a) and 12-1005(b) AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT RELATING TO THE TERM OF OFFICE OF GOVERNING BODY MEMBERS UPON THE ADOPTION OF THE CITY MANAGER PLAN OF GOVERNMENT.

Be it Ordained by the Governing Body of the City of Ottawa, Kansas:

Section 1.         The City of Ottawa, Kansas, by the power vested in it by Article 12, Section S, of the Constitution of the State of Kansas, hereby elects to make inapplicable to it and exempts itself from Kansas Statutes Annotated 12-1005(a) and 12-1005(b) which applies to said city but not uniformly to all cities and provides substitute provisions on the same subject as hereinafter provided.

Section 2.         The Governing Body members shall be elected hereafter at regular city elections as follows, to-wit: One governing body member shall be elected at the next general city election to hold office until his term expires with the general city election of 1974. The governing body member elected for a regular term in the year 1970 shall have a term expiring in 1973. The governing body member elected in the year 1969 shall have a term expiring in 1972. Commencing with the regular city election of 1971, one governing body member shall be elected each year thereafter for a three year term. At each regular city election, the person receiving the largest number of votes shall thereby be elected to the three year term of office as a governing body member.
